Terms of Service

By commissioning me, you acknowledge you have read, understood, and agreed to the following terms.
I reserve the right to change these terms and conditions at any time without prior notice.
I reserve the right to decline a commission.
No offensive or explicitly sexual imagery.
1: Process
1.1 You can contact me to tell me about your commission on any online platform and we’ll continue the conversation to work out the commission details by email ([email protected]).
1.2 Once the commission work is defined, I’ll send you an invoice for the first payment of 50%. I can start working on your commission only after I’ve received the first payment in full. Read the Payment section below to know more about how the payments work.
1.3 After the first payment is made, all you have to do is wait for your turn to come up on the waitlist. Once it’s your turn, I’ll notify you by email and start working on your commission!
1.4 I’ll send you commission updates, so you can check the work and request any changes, if necessary. Read the Revisions section below to know more about how many changes you can request for free.
1.5 The time of the commission work will depend on the complexity of the artwork, my workload and on how promptly you pay the invoices and answer the emails. Besides that, if anything unavoidable happens that will cause delays, I’ll notify you right away.
If we agree on a deadline, I will endeavor to have the artwork finished by that date, but I am not responsible for a missed launch date or a deadline if you have been late in supplying materials, paying invoices or answering emails.
If you are going to be delayed at any step of the process, please notify me. We can make arrangements to accommodate your situation.
1.6 Once the artwork is ready, I’ll send you an invoice for the second payment of 50%. I’ll send you the finished artwork in full resolution only after I’ve received the final payment in full.
2: Payment
2.1 All payments from outside the Netherlands should be sent through PayPal in USD.
Commissioners from the Netherlands can also opt for bank transfer payment, after which you will receive payment information to make the payment.
2.2 I require a 50% payment upfront, before I start working on the commission, and 50% payment at the end, before I deliver the full size version of the finished artwork.
2.3 the payments are made through PayPal invoices
I’ll send you an invoice through Paypal for each payment.
Do not send me any kind of payment without using the invoice. All money sent to me without using the Paypal invoice will be considered as a tip.
2.4 If the first payment is not received within 10 calendar days of the date stated on the invoice, I’ll have to move you to the bottom of the waitlist and give your spot to the next person in line. The second time around that I send you the invoice and you don’t pay within the next 10 calendar days, I’ll remove you from the waitlist.
2.5 If the second payment is not received within 30 calendar days of the date stated on the invoice, any progress on the artwork will be deleted.
2.6 You certify that you are the owner of the bank account or Paypal account you use to pay for the commission, or that you have explicit permission from the owner of the account.
3: Deliverable
3.1 You're purchasing a digital file only, not a print, so no goods will be shipped.
3.2 You will receive a .PNG/JPEG file, along with the PSD of the artwork, unless otherwise agreed.
3.3 I’ll send you the file via email or WeTransfer.
3.4 My watermark will always be in the final image. Please, do not remove it.
3.5 Once I’ve sent you the finished artwork, I'm not held responsible if it's deleted from websites or if you lose it. As soon as I send you the artwork, download it, save it and secure it, because I may clean my hard drive from time to time, and I could erase said artworks.
4: Revisions
4.1 You can request the following revisions when I send you the commission updates:
big changes during the thumbnails stage (e. g. change the pose, change the clothes, change the face/hair, etc)
small changes throughout the whole process (e. g. change the lips, change the color of a small area, change the details of a small area)
4.2 Additional revision changes not stated here will be denied or will come at an extra cost that must be paid upfront.
4.3 Every time I send you a commission update you have the chance to ask for a revision. If I don't receive a reply asking for a change in the next 48 hours after I’ve sent a commission update, I'll assume the progress has been approved and I'll continue working on the next step. Any dissatisfaction with the artwork afterwards will not be my responsibility.
4.4 During the updates, you’ll receive the images in a limited resolution. You’ll receive the full resolution artwork after I receive the final payment.
5: Cancellation and Refund Policy
5.1 You can cancel the commission at any time before payment.
5.2 If you cancel your commission after you have made the first payment, I can refund you a percentage of the money depending on how far in the process I am:
100% refund if I have not started working yet
50% refund if I already started gathering references and working on the mood board
No refunds if I reached the refined sketch/line art stage
5.3 I have the right to cancel your commission at any time in the case of unforeseen or extreme circumstances, with a refund based on how much of the artwork was completed already. Of course you will get a proper explanation on how and why.
6: License and Usage
6.1 As the artist, I retain all copyrights to the produced artwork, including but not limited to:
Post/display the artwork, thumbnails, sketches, process recordings, and any other WIPs anywhere I want (giving you proper credit as the owner of the characters when needed).
Use it to promote myself.
Offer any of the digital files on personal profit based websites, such as Patreon, Gumroad and similar sites in the form of tutorials.
Feature the artwork in any book I publish.
The artwork will not be posted openly, if an agreement on this is made with said commissioner.
6.2 will not sell your commission, unless you explicitly tell me you're okay with it.
7: Personal Commissions
7.1 As the commissioner, you are allowed to:
Post the artwork in any website/social media as long as it's non-commercial and I'm credited as the artist.
Print the artwork in any kind of merchandising as long as it is for your personal use only and not for commercial purposes.
Use the artwork as signature, avatar, banner or decoration on your personal, non profit accounts.
You may use the artwork to practice your lines and coloring as long as you give me proper credit.
7.2 As the commissioner, you are not allowed to:
Use the artwork in any way that will generate revenue. All personal commissions are intended for private use only and are not to be reproduced, edited or used for any commercial purposes, including advertising and sales. Keep in mind that any activity that generates revenue or is meant to promote your product or brand is considered a commercial activity. If you wish to gain commercial rights to a commissioned piece, request a commercial commission instead.
Claim the artwork as your own, modify, copy, trace or heavily reference it and claim it as your own.
8: Commercial Commissions
8.1 We need to discuss the intended usage of the artwork in order to sign a contract or Licensing Agreement that specifies the copyrights granted. If your company doesn't have a standard Licensing Agreement, I’ll provide you one.
